An employee of a cooperative bank was punished in 1995 with freezing of 5 increments. He filed an appeal 3 days late (due to intervening weekend). The Cooperative Tribunal rejected it on limitation grounds. The Supreme Court held that Section 5 of the Limitation Act (allowing condonation of delay for sufficient cause) applies automatically to proceedings under the Cooperative Societies Act through Section 29(2) of the Limitation Act. The 2-day delay (falling on Saturday and Sunday) constituted sufficient cause and must be condoned. The Court set aside the Tribunal's order and remitted the appeals for merit-based disposal.
