In Brief
This appeal concerns the quashing of a complaint filed against the appellants in a family dispute. The complaint alleged offences under Sections 498A (cruelty), 323 (causing hurt), 504 (insult), and 506 (criminal intimidation) of the Indian Penal Code. The Supreme Court found that the facts stated in the complaint did not constitute any justifiable basis or prima facie case to proceed against the appellants for the alleged offences. Accordingly, the complaint was quashed and the order issuing summons was set aside, while reserving the right of the Magistrate to decide the case against the husband (who was not a party to these proceedings) on its merits.
