TABREZ KHAN @GUDDU vs THE STATE OF UTTAR PRADESH

Bench: 2 — Abhay Manohar Sapre, Dinesh Maheshwari

In Brief

Tabrez Khan and his brother and mother were accused of dowry harassment (Section 498A IPC) and other offences (Sections 323, 504, 506 IPC) by his brother's wife. The appellants filed an application under Section 482 Cr.P.C. to quash the complaint and summoning order, which the High Court rejected. The Supreme Court found that the complaint contained no justification or prima facie case against the appellants. The Court set aside the High Court's order, allowed the appeal, and quashed the complaint against the appellants, while reserving the case against the husband for decision on merit by the Magistrate.
