A bank's customer claimed that two demand drafts worth ₹8 lakhs were wrongly credited to a separate account opened in a similar name, alleging the bank's negligence and collusion. The customer sought recovery and compensation. The bank argued the account was opened on instruction of one of the company's co-directors in good faith and following proper procedure. The Supreme Court held that complaints involving disputed factual questions or allegations of fraud cannot be decided by Consumer Commissions, as their proceedings are summary in nature. The Court found no deficiency in service, as the bank's employees had acted bona fide. The appeal was allowed and the lower orders quashed.
