Yogesh Aggarwal challenged an order of the National Consumer Disputes Redressal Commission (NCDRC) directing him to pay cheques signed by him, plus interest. The Supreme Court held that the complaint was not maintainable because it was filed by an unregistered entity (Investor Forum Aneja Group) without obtaining prior permission from the forum as required by Section 12(1)(c) of the Consumer Protection Act, 1986. Additionally, since Aneja Consultancy was a sole proprietorship and Aggarwal was merely an employee, he could not be held personally liable. The Court allowed the appeal, set aside the NCDRC order, dismissed the complaint, and ordered refund of any deposited amount with accrued interest."
