Supreme Court of India 2024-03-12 remanded

THE EXECUTIVE ENGINEER, KNNL vs SUBHASHCHANDRA & ORS

Bench: 2 — Surya Kant, K.V. Viswanathan

In Brief

These consolidated civil appeals challenge the High Court of Karnataka's enhancement of compensation for approximately 178 acres of land acquired by Karnataka Neeravari Nigam Limited (KNNL) for three irrigation projects—Bennethora, Lower Mullamari, and Amarja—between 1982 and 1994. The Supreme Court remanded the cases to the High Court, directing it to conduct a holistic, project-wise and notification-wise review to ensure uniformity in compensation awards while protecting compensation already paid to some landowners that had become final. The Court noted the High Court had failed to analyze cases individually and did not properly apply relevant legal parameters.
