THE EXECUTIVE ENGINEER vs THE STATE OF MAHARASHTRA

Bench: 3 — Uday Umesh Lalit, Indira Banerjee, M.R. Shah

In Brief

The Executive Engineer of a water project challenged a High Court judgment that enhanced compensation for acquired land and awarded interest for the period of delayed appeal. The Supreme Court held that although delaying the appeal was proper to condone, interest on enhanced compensation should not be awarded for the delayed period since the delay was not attributable to the acquiring authority. Relying on precedent, the Court allowed the appeals in part, denying interest to the land claimants for the delayed period while confirming the enhanced compensation amount itself.
