The Tribunal and High Court dismissed the State's challenge, but the High Court gave no reasoned findings. The Supreme Court remanded the matter to the High Court to reconsider all parties' contentions and provide a substantive reasoned decision on the applicability of the RACP Scheme, the counting of prior promotions as benefits, and the legal effect of subsequent Government clarifications.
