The High Court directed the government to step up the seniors' pay to eliminate this anomaly, relying on Financial Rule 22. The Supreme Court upheld this decision, holding that where seniors promoted to a higher substantive post draw less than juniors gaining upgradation benefits in identical posts, pay must be stepped up under the anomaly-removal rule, distinct from the scheme's benefits. The appeal was dismissed.
