The Tuticorin Port Democratic Staff Union challenged the High Court's Division Bench order that dismissed their writ petition seeking regularization of canteen workers employed at the Port Trust's premises. The Supreme Court found that the union had submitted material documents for the first time in the appeal before it, which neither the single judge nor the division bench had examined. Since these documents were material to the case, the Court set aside both orders and remanded the matter to the single judge to decide the writ petition afresh on merits, allowing the parties to place all necessary evidence for consideration.
