Tuticorin Port Democratic Staff Union sought the regularisation and absorption of canteen workers employed at Tuticorin Port Trust into the Trust's permanent workforce. The High Court's Single Judge allowed the workers' petition, but the Division Bench reversed this decision. The Supreme Court found that material documentary evidence was submitted for the first time in the appeal stage and had not been examined by either court below. Rather than deciding the merits itself, the Court remanded the case to the Single Judge to reconsider the workers' entitlement to regularisation with full access to all evidence and without being influenced by prior judicial observations."
