Amar Nath Dwivedi was appointed as Training Officer to the U.P. Co-operative Spinning Mills Federation Limited on a contractual basis for one year (September 1998–September 1999). When the contract ended, he filed a writ petition seeking reinstatement, claiming the contractual appointment was arbitrary. The High Court accepted his plea and ordered reinstatement with back wages. The Supreme Court reversed this, holding that an appointment explicitly made on a contractual basis for a fixed period is not arbitrary and must be honoured according to its terms. Since there was no sanctioned permanent post and no evidence of permanent employment, the employee could not claim reinstatement or absorption into State services merely based on deputation. The appeal was allowed and the High Court's order was set aside.
