U.P. Co-Op. Spinning Mills Fedn. Ltd. & Ors vs Amar Nath Dwivedi & Anr

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

A Training Officer appointed on a one-year contract to U.P. Co-operative Spinning Mills Federation Limited was relieved after the contract expired without renewal. The High Court had reinstated him with back wages, treating the contractual conditions as arbitrary. The Supreme Court reversed this, holding that a contractual appointment for a fixed period cannot be treated as invalid merely because conditions seem harsh. The respondent has no legal claim to permanent employment or State absorption. However, the Court noted the State may engage him on suitable terms if it wishes, while expressly declining to advise on future action.
