U.P. State Road Transport Corporation vs Sandeep Kumar Jain & Ors

Bench: 2 — Mohan M. Shantanagoudar

In Brief

The Supreme Court allowed the appeal by the U.P. State Road Transport Corporation, setting aside a High Court judgment that had quashed the cancellation of transport permits on the Dewal-Bijnor route. The Court held that private operators cannot operate vehicles on notified/nationalized routes except as authorized by the scheme. Although the respondents were existing operators on non-notified routes, they had no right to continue operating once the route became notified under the 1997 nationalization scheme. The Court confirmed that status as an existing operator provides no exemption from the statutory bar against private operators on nationalized routes.
