Uma Shanker Sharma had filed a Criminal Appeal (No. 770/2010) in the Supreme Court. During the pendency of the appeal, the appellant died on 27 July 2021. The Court, upon being informed of the death and being shown the death certificate, held that the appeal abates on account of the death of the sole appellant. The judgment establishes that a criminal appeal terminates automatically upon the death of the only appellant pursuing it, as the right to prosecute the appeal is personal to the appellant and does not survive their death.
