The State of U.P. filed a criminal appeal against Mithun Singh challenging his acquittal by the High Court of Allahabad. While the appeal was pending before the Supreme Court, the State filed an application stating that the respondent had died on 28 October 2019 and produced his death certificate as evidence. The Supreme Court held that the criminal appeal abates upon the death of the sole accused and disposed of the appeal accordingly.
