Umesh vs State of Kerala

Bench: 2 — Kurian

In Brief

The appellant, accused No. 5 in two criminal cases from 1996, challenged the High Court's refusal to quash the pending proceedings against him. The appellant argued that since he was not available for trial and other accused had already been acquitted or convicted, continuing proceedings against him was wasteful. The Supreme Court did not interfere with the High Court's refusal, but instead directed the appellant to surrender and furnish bail, allowing him to file applications under Section 239 of the Criminal Procedure Code before the trial Magistrate to seek quashing or discontinuance of the proceedings on merits.
