Kuyadat Ali and Ors vs State of U.P. and Ors

Bench: 2 — Kurian

In Brief

In this criminal appeal, the Supreme Court disposed of a challenge to the High Court's order declining to quash an FIR registered against the appellants. The High Court had granted interim protection from arrest to some appellants, subject to their cooperation with the investigation. After the investigation was completed and a final report was filed under Section 173(2) of the Criminal Procedure Code, the Court found no purpose in keeping the appeal pending. The Court directed the appellants to surrender before the trial court, which was to release them on bail upon furnishing bail bonds of Rs.10,000 each with two sureties, without examining the merits of the case.
