Unichem Laboratories Ltd vs Rani Devi & Anr

Bench: 2 — Abhay Manohar Sapre

In Brief

An employer company sought to evict a former employee's family from a company-allotted quarter under the Uttar Pradesh Industrial Housing Act, 1955. The High Court dismissed the suit on grounds of lack of locus standi. The Supreme Court reversed this decision, holding that: (1) Civil Courts retain jurisdiction to try eviction suits of civil nature unless jurisdiction is expressly barred by statute; (2) Section 13 of the Act bars only workers' challenges to administrative orders, not eviction suits by employers; (3) A contractual tenancy exists between employer and employee-allottee; (4) This tenancy terminates upon the employee's retirement, making continued occupation illegal; and (5) The dependents have no independent right to the quarter. The eviction decree was restored.
