In Brief
An employer-company sought eviction of a former employee's widow from an industrial housing quarter allotted during his employment. The High Court dismissed the suit, holding the company lacked standing. The Supreme Court reversed, holding that deletion of the Labour Commissioner's eviction powers in 1972 restored Civil Court jurisdiction under the CPC. Section 13 of the Industrial Housing Act merely bars judicial review of administrative orders; it does not oust Court jurisdiction over eviction suits. The employer had valid contractual standing to sue, as employment-linked tenancy terminates upon job cessation. The widow's continued occupation was unlawful, warranting eviction and payment of use and occupation charges."
