The Supreme Court decided whether personnel below officer rank who retired between January 2006 and August 2008 were entitled to Modified Assured Career Progression (MACP) benefits from January 1, 2006 or only from September 1, 2008. The Court held that MACP is part of the pay structure—not an allowance—and thus applies from January 1, 2006 when the Government accepted the 6th Pay Commission's recommendations on pay bands and grade pay. An administrative instruction later restricting MACP to September 1, 2008 was declared ultra vires. The appeals were dismissed and the AFT's decision upheld."]
