The Supreme Court upheld the Government's decision to implement the Modified Assured Career Progression Scheme (MACPS) from September 1, 2008, rather than January 1, 2006, for civilian employees. The Court held that MACPS benefits are incentive schemes, not part of pay, and are admissible only to the next grade pay in the same pay band, not to the next promotional post. The Court distinguished its earlier judgment in Balbir Singh Turn and followed M.V. Mohanan Nair, confirming that retroactive implementation would require large-scale recoveries from employees and be unjust to retirees. Several related appeals were remitted for further hearing on distinct issues regarding Sub-Inspector promotions.
