The Union of India appealed three issues concerning the Modified Assured Career Progression (MACP) Scheme for Central Armed Police Forces. The Supreme Court held: (1) MACP applies from 1st September 2008, not 1st January 2006; (2) financial upgradation under MACP is to the immediate next grade pay in the hierarchy, not to the next promotional post's pay—the scheme is an incentive to relieve stagnation, not part of pay structure; and (3) Central Armed Forces personnel may be granted upgradation despite unfulfilled pre-promotional course requirements if administrative reasons prevented participation. The Court partly allowed the appeal, reversing the High Court's finding on the effective date and scope of entitlement, while accepting the High Court's position on pre-promotional norm relaxation.
