The Union of India appealed against a High Court decision that directed reinstatement of the respondent to the Sub-Inspector post. The Union had denied appointment because an FIR was registered against the respondent for teasing a girl when he was a minor (charges under IPC Sections 354, 447, 509). The respondent was acquitted due to lack of evidence and had disclosed the charges in his appointment form. The Supreme Court held that conduct committed during minority cannot constitute moral turpitude disqualifying from public employment, and that voluntary disclosure of charges is not suppression. The appeal was dismissed.
