Supreme Court of India 2017-11-24 dismissed

Union of India & Ors vs A. Rayer & Ors

Bench: 2 — Kurian

In Brief

The Union of India appealed against concurrent findings of the Central Administrative Tribunal and High Court that Police Constables in Andaman & Nicobar Islands should receive the same pay scale as Delhi Police Constables, following an Anomaly Committee recommendation. The appellant argued that classification based on educational qualifications (matriculate vs. non-matriculate) was permissible. The Supreme Court dismissed the appeal, holding that concurrent findings by two courts warranted no interference under Article 136. The Court vacated the High Court's cost order but clarified that if arrears remained unpaid within six months, costs would revive. No further time extensions were granted.
