The Union of India appealed a High Court order directing the appointment of a woman worker under its Evictee Scheme. The worker had performed as a Technical Assistant for over seven years and sought appointment as a Fitter (Grade B). However, the Evictee Scheme only provides for Grade C or D positions. The Supreme Court allowed the appeal in part, directing appointment as a Catering Attendant Grade C post while leaving open scope for appropriate utilization of her skills. The Court emphasized this was a one-off decision based on peculiar facts and should not be treated as precedent.
