Two contractual TV employees engaged in 1988 were declared government servants in 1992 but denied promotion despite working for 12 years. They challenged this in the Administrative Tribunal, which allowed their claims. The government appealed to the High Court and Supreme Court, arguing the Rules did not cover their posts. The Supreme Court upheld the Tribunal and High Court, holding that employees declared as government servants on regular posts in qualifying pay scales are 'departmental candidates' entitled to all service benefits including promotion consideration under the Rules. The Court clarified that existing promotions and seniority remain unaffected; retired employees get notional pay adjustments; and future promotions are considered against vacancies."
