Major General Arun Roye, an officer commissioned through the National Defence Academy in 1967, challenged his non-empanelment as Lieutenant General. The Supreme Court upheld the High Court's decision that his service profile was tainted by irregular figurative assessments made contrary to established policy, and that he was illegally denied a second mandatory look for the National Defence College course. The Court found no reason to disturb the Single Judge's directions for re-assessment by the Special Selection Board but rejected the Division Bench's observations on issues not addressed by the learned Single Judge, holding they went beyond the scope of relief granted and were unsustainable.
