A trained graduate teacher was granted Assured Career Progression (ACP) in August 2006, placing him in a higher pay scale. When the Sixth Pay Commission's revised rules took effect in 2008, his pay was fixed under Rule 7. The teacher claimed it should have been fixed under Rule 11, applicable when employees opt to switch to the revised structure from their upgradation date. The Supreme Court held that Rule 11 applies because his upgradation came from the ACP scheme, not from the Sixth Pay Commission's recommendations. Rule 7's Note 2A applies only to CPC-recommended upgradations. The appeal was dismissed, requiring correct pay fixation under Rule 11.
