Union of India challenged an order dismissing a show-cause notice against respondents for importing certain goods. The notice was based on a 1986 order issued under the repealed Imports (Control) Order. After the Foreign Trade (Development and Regulation) Act, 1992 came into force, imports of those goods were permitted. The Supreme Court held that the quasi-judicial 1986 order could not be saved by the repealing Act's savings clause because it was repugnant to the 1992 Act's liberalizing intent. The appeal was dismissed as no valid basis existed to enforce the 1986 order against imports made under the new, permissive regime.
