A mother challenged the High Court's decision that set aside a gift deed she had executed to her son. She had transferred her property to him on the condition that he maintain her and provide for her basic needs. When he allegedly failed to do so and they had a breakdown in relations, she sought cancellation of the gift under the Maintenance and Welfare of the Parents and Senior Citizens Act, 2007. The Supreme Court held that beneficial legislation protecting senior citizens must be interpreted liberally in their favour. The Court found the condition of maintenance was evidenced by both the gift deed and a contemporaneous promissory note, and since the son failed to provide the required care, the gift deed was properly rescinded.
