In 1996, a worker challenged his termination before the Labour Court, Dehradun, which declared the termination illegal. The employer filed a writ petition in the Allahabad High Court to challenge this award. During the proceedings, the State of Uttarakhand was created, bringing Dehradun under its jurisdiction. The Allahabad High Court permitted withdrawal with liberty to file the petition before the appropriate High Court (Uttarakhand). The Uttarakhand High Court later dismissed the petition, criticizing the Allahabad order. The Supreme Court held that a coordinate judge cannot critique another High Court's judicial order, and the Allahabad High Court was right in allowing withdrawal and refiling. The case was restored for decision on merits.
