In Brief
A co-operative housing society purchased land and made an agreement to sell part of it to a tenant (Manicklal). When the society later tried to sell the land to third parties, Manicklal filed a dispute within 30 days of learning of this action. An Arbitrator upheld his claim, but a Cooperative Tribunal set aside the award. The High Court restored the Arbitrator's decision as proper. The Supreme Court held that the Arbitrator correctly determined the dispute was timely, that the sale agreement fell within the society's constitutive powers, and that the Tribunal illegally interfered with a proper award. The appeal was dismissed."
