In Brief
A faculty member of NUJS Kolkata filed a sexual harassment complaint against the Vice Chancellor in December 2023, alleging unwelcome advances and threats beginning in 2019 and continuing until April 2023. The Local Complaints Committee rejected the complaint as time-barred under the POSH Act (which prescribes a three-month filing period, extendable to six months). While the High Court initially allowed her writ petition, the Division Bench reversed it. The Supreme Court upheld the dismissal, holding that the April 2023 incident was the last harassment event; subsequent administrative removal in August 2023 was a collective decision by independent bodies, unrelated to harassment. However, the Court directed that this judgment be permanently recorded in the respondent's resume to ensure the wrongdoing is never forgotten.
