Supreme Court of India 2020-11-20 dismissed

Venkatesan Balasubramaniyan vs Intelligence Officer, D.R.I. Bangalore

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

The Supreme Court dismissed three consolidated criminal appeals challenging the High Court's cancellation of bail granted to the appellants in a narcotic drugs case. The appellants had been granted bail by the trial court on the ground that the charge-sheet was not filed within the time prescribed under CrPC Section 167(2). The Court held that delayed charge-sheet filing alone does not entitle an accused to bail in NDPS cases when substantial material exists connecting them to the offence. The Court allowed the appellants to file fresh bail applications before the Special Court to be decided on merits without prejudice from the High Court's observations.
