Police claimed they informed his wife instead and made a diary entry. The Supreme Court held that informing an arrestee's grounds for arrest is a mandatory constitutional right under Article 22(1). Communicating grounds to the wife, mentioning them in remand reports, or relying on diary entries does not satisfy this requirement. The Court vitiated the arrest and ordered immediate release, clarifying that even filed chargesheet cannot validate unconstitutional arrest. The Court also directed the State to issue guidelines preventing inhumane treatment of arrested persons in hospitals.
