This case concerned the extent of bhumidari (agricultural land tenure) rights over land jointly purchased and jointly claimed by three parties. All three filed a revenue suit and were declared joint bhumidhars in equal 1/3rd shares each. Later, one party claimed a 1/10th share in a partition suit; this was initially granted by the Assistant Collector, but after remand, he recognized the 1/3rd shares recorded in the joint names. The Supreme Court upheld the order of the Single Judge that the lower courts' decisions granting 1/10th share were perverse as they ignored the binding decree of the joint suit. The Court dismissed the appellants' challenge, holding that the 1/3rd equal share declaration stands.
