Vijay Kumar Joshi vs Akash Tripathi & Ors

Bench: 2 — Vikram Nath, Prasanna B. Varale

In Brief

Employees of Societies absorbed into the Madhya Pradesh State Electricity Board (MPSEB) challenged the High Court's decision denying them pension benefits. The Supreme Court held that absorbed employees are entitled to pension because they perform identical duties as regular MPSEB employees and denying them benefits solely based on their origin in societies amounts to unjust discrimination. However, service rendered in societies before absorption cannot count towards pension qualification because it was not under State Government regulation. The Court ordered pension to be payable from the date of absorption, with all arrears to be paid within four months.
