The State of Uttar Pradesh challenged a High Court order directing it to grant the higher pay scale of 7500-12000 to Sub-Deputy Inspectors of Schools and Deputy Basic Shiksha Adhikaris with effect from 2001. The dispute arose from a pay discrepancy created when Headmasters' pay was revised in 2001 but these officers' pay was not. The Supreme Court held that the Supreme Court's own 2010 order dismissing the State's appeal, after approving a settlement proposal, merged the earlier High Court judgment and became the binding decision. Accordingly, the 2011 Order implementing the approved policy was valid. The Court partly allowed the appeal, approved the 2011 Order granting benefits from December 2008, and directed no recovery of overpaid amounts from retired employees, invoking Article 142 to achieve substantial justice in this 22-year-old dispute.
