Vijay Kumar was convicted and sentenced to death for murdering three minor children and injuring others in a midnight attack arising from a matrimonial dispute. The High Court confirmed the conviction and death sentence. The Supreme Court held that while the offence was grave and brutal, it did not fall within the 'rarest of rare' category warranting capital punishment. Considering that the accused was not a habitual criminal and the crime stemmed from family dispute, the Court commuted the death sentence to life imprisonment till natural death without remission, partly allowing the appeal.
