The High Court granted a certificate of fitness allowing Vineeta Sharma to appeal to the Supreme Court based on conflicting decisions in three earlier Supreme Court cases: Prakash v. Phulavati, Danamma @ Suman Surpur v. Amar, and Mangammal v. T.B. Raju. The Supreme Court accepted that these conflicting precedents warranted constitution of a larger bench to hear the matter finally. A three-judge bench was constituted, and the case was adjourned to allow both parties time to prepare for substantive hearing on the legal issue requiring resolution.
