Vinod Goyal & Others vs Vishranti City Residents Welfare Society & Others

Bench: 2 — R. Banumathi

In Brief

The Supreme Court allowed an appeal by partners of a real-estate developer against an order by the High Court of Punjab and Haryana directing auction of their personal properties to fund completion of an unfinished residential colony. The Court held that partners cannot have their individual assets attached without being made parties to proceedings and hearing them. The dispute involved whether allottees or the developer must bear external development and electricity connection charges. The Court remitted the matter to the High Court for fresh consideration, affording both parties opportunity to resolve the dispute and complete the project, rather than through forced asset sale.
