The appellant sought to overturn a lower court's decree granting the plaintiff exclusive ownership and possession of a residential property in Tagore Garden, New Delhi. The property was initially allotted to the plaintiff's sister in 1963 and transferred to the plaintiff's name in 1966. The Court held that despite being registered in the plaintiff's name, the property was joint family property purchased and constructed with the father's funds. Since the entire family lived in the property from inception, the plaintiff never actually resided there, and he had no income when acquired, the Court found the plaintiff failed to establish exclusive ownership. The appeals were allowed and the suit dismissed."
