Vinod Kumar vs Amritpal @ Chhotu & Ors

Bench: 2 — Abhay S. Oka

In Brief

The Supreme Court heard an appeal against the High Court's conviction downgrading murder to culpable homicide. The victim died from injuries including fractured ribs and a ruptured lung and liver caused by multiple assailants who forcibly held him down. The High Court had erred by finding injuries were only on non-vital parts. The Court held that under Section 300 'Thirdly' IPC, once the prosecution proves the presence of a bodily injury, its nature, and the intention to inflict it, proving the injury is objectively sufficient to cause death makes it murder—the accused's intention to kill is irrelevant. All elements were satisfied here. The appeal was allowed, the murder conviction restored, and life imprisonment reinstated."}
