Virendrabhai Devjibhai Patel vs Keshavbhai Makanbhai and Ors Etc

Bench: 2 — Kurian

In Brief

In this property dispute, an interlocutory injunction dated 2007 restricted defendants from transferring or interfering with an undivided share of 20,700 sq.m. of land. Despite the injunction, defendants transferred 6,900 sq.m. to specific parties in 2008. The trial court cancelled the sale deed; the High Court reversed, saying cancellation exceeded jurisdiction. The Supreme Court held the High Court's view was not wholly correct, as the transfer of a specific portion violated the injunction's spirit, which permitted only undivided share transfers. Rather than cancel, the Court directed parties to execute a rectification deed clarifying the 6,900 sq.m. was transferred as an undivided share, not a specific portion, and to complete the suit within one year with no further alienation pending."
