VIRUDHUNAGAR HINDU NADARGAL DHARMA PARIBALANA SABAI vs TUTICORIN EDUCATIONAL SOCIETY

Bench: 3 — Rohinton Fali Nariman, Surya Kant, V. Ramasubramanian

In Brief

A dispute arose between members of the Tuticorin Educational Society over the legality of convening General Body and Executive Committee meetings and elections. The trial court granted an interim injunction restraining the meetings, but the High Court set aside this order. The Supreme Court allowed the appeal, holding that when a specific appellate remedy exists under the Code of Civil Procedure, the High Court cannot exercise supervisory jurisdiction under Article 227. The Court appointed an Advocate Commissioner to oversee fair elections, directing the commissioner to coordinate with sponsoring bodies and conduct elections according to bylaws, thus ending years of successive litigation before multiple forums.
