In Brief
Under the Maharashtra Agriculture Land Ceiling Act, 1961, the appellants challenged an order finding certain land holdings to be in excess of the ceiling limit. The core dispute concerned the classification of "pot kharab" (uncultivable) land: earlier proceedings had identified 106.24 acres as uncultivable, but later proceedings found only 28.20 acres as such. The Supreme Court held that revenue records enjoy a presumption of truth. Although rebuttable, the burden falls on the party disputing the entries to produce evidence. The appellants failed to present prior revenue records or evidence challenging the classification, thereby failing to discharge their burden. The appeals were dismissed.
