In Brief

The Supreme Court reversed the High Court's order that had allowed Abdul Halim's candidacy for the post of Assistant Teacher in a Bengali medium school on the basis of a one-year Certificate Course in Bengali from Delhi University. The Court held that such a part-time certificate course, which admits only language beginners at graduate level, does not constitute 'higher level of education' under the applicable recruitment rules. The Court also clarified that High Courts exercising writ jurisdiction cannot sit in appeal over administrative eligibility determinations; they can only intervene for manifest error or manifest arbitrariness. The appeal was allowed and Halim's selection was cancelled.
