Eight retired Assistant Professors and a College Librarian from Manipur sought revised pension benefits from 1st April 2010 under the pension rules applicable to State Government employees. The State Government sought to limit their entitlement to 1st November 2010 through a clarificatory order. The Supreme Court held that once the retirees were placed under the State Government pension regime through a statutory order, they acquired a vested right to the pension entitlement date applicable to all State Government retirees. A subsequent administrative clarificatory order without statutory force cannot override this vested right. The Court allowed the appeal and restored the Single Judge's judgment awarding revised pension from 1st April 2010.
