University professors challenged retirement orders dated 21 December 2019, arguing they were entitled to continue in service until 30 June of the following academic year under Statute No. 16.24, rather than retiring at month-end when they attained age 65. The High Court rejected their petition. The Supreme Court held that the proviso to Statute No. 16.24 clearly entitles teachers not retiring on 30 June to continue until 30 June of the following academic session on re-employment basis, to prevent mid-session disruption and protect students' educational interests. The Court set aside the High Court judgment, allowing the appeals and directing reinstatement with full back wages.
